Sekyu, walang “K” kumuha ng driver’s license sa papasok sa condo

Dear Chief Acosta,

Pumunta ako sa condo ng kaibigan ko na si Topher upang siya ay sunduin. Sa gate pa lamang ng condo ay hinarangan ako ng guwardiya at iginiit ang pagkuha ng driver’s license ko. Ayaw niyang tumanggap ng ibang uri ng ID. Kung hindi ko diumano ibibigay ang driver’s license ko ay hindi diumano ako papapasukin. May karapatan ba talaga ang guwardiya ng condo na igiit ang pagkuha ng driver’s license bago payagan ang isang motorista na makapasok? — Veya

Dear Veya, 

Ang kapangyarihan na magkumpiska ng driver’s license ay tanging nasa mga law enforcement at peace officers lamang na itinalaga ng commissioner ng Land Transportation Office (LTO). Ang patakarang ito ay nakasaad sa Section 29 ng Republic Act (R.A.) No. 4136, o mas kilala bilang Land Transportation and Traffic Code, na nagsasaad na: 

“Section 29. Confiscation of driver’s licenses. - Law enforcement and peace officers duly designated by the Commissioner shall, in apprehending any driver for violations of this Act or of any regulations issued pursuant thereto, or of local traffic rules and regulations, confiscate the license of the driver concerned and issue a receipt prescribed and issued by the Commission therefor which shall authorize the driver to operate a motor vehicle for a period not exceeding seventy-two hours from the time and date of issue of said receipt.  The period so fixed in the receipt shall not be extended and shall become invalid thereafter.  Failure of the driver to settle his case within fifteen days from the date of apprehension will cause suspension and revocation of his license.”

Malinaw na ang mga law enforcement at peace officers na itinalaga ng commissioner ng LTO ang may karapatan na kumpiskahin ang driver’s license ng mga motorista na lumabag sa R.A. No. 4136, sa mga regulasyong inilabas alinsunod dito, at sa mga lokal na alituntunin at regulasyong pantrapiko. 

Gayundin, nakasaad sa Rule XIV, Section 99 ng Department Order No. 2021-007 – 2021, o mas kilala bilang “Revised Implementing Rules and Regulations of Republic Act No. 9904,” na inilabas ng Department of Human Settlements and Urban Development (DHSUD) noong 15 Setyembre 2021, na:

“Section 99 (i)  Prohibited Acts. It shall be prohibited for any person or association: 

xxx

1. To require the driver of any vehicle entering the subdivision/village or community to surrender his/her driver’s license.”

Samantalang ang parusa sa paglabag sa batas na ito ay nakasaad sa Rule XVI, Section 103 nito na nagsasaad: 

“Section 103. Penalties and Sanctions. The following penalties and sanctions,as provided under Republic Act No. 9904, shall be imposed, after due notice and hearing:

a. Fine of not less than Five Thousand Pesos (P5,000.00) but not more than Fifty Thousand Pesos (P50,000.00); and

b. Permanent disqualification from being elected or appointed as member of the Board, officer or employee of the Association, shall be imposed on serious and grave offenses without prejudice to being charged before a regular court for violations of the provisions of the Revised Penal Code, Civil Code and other pertinent laws.

If the violation is committed by the association, the members, officers, trustees or directors of the association who have actually participated in, authorized, or ratified the prohibited act shall be held liable.

If the violation is committed by the employees and agents who acted in gross violation hereof, the officers, trustees or directors, or incorporators of the association, shall be jointly and severally liable with the offending employees, agents, and the association.”

Kung kaya’t sa iyong kaso, walang awtoridad ang mga guwardiya ng condo na igiit sa sinumang tao o motorista na isuko ang kanilang driver’s license, bilang tanging kondisyon para sa pagpasok sa loob ng kanilang establisimyento. Ang lumabag sa patakarang ito ay maaaring managot at magmulta ng hindi bababa sa P5,000.00 at hindi lalagpas ng P50,000.00. Ito ay ipapataw sa mga miyembro, opisyal, tagapangasiwa, o mga direktor ng asosasyon na aktuwal na lumahok, nagpahintulot, o nagpatibay sa ipinagbabawal na gawain.
