Parusa sa paggamit ng matapang na surfactants sa mga detergent

Kasama sa listahan ng bilihin ko ang mga sabong panlaba, at ang madalas na binibili ko ay mga produkto galing sa ibang bansa. Ganoon pa man, nais ko lang malaman sana kung may batas ba sa bansa natin patungkol sa mga kemikal na ginagamit maski sa mga inangkat na sabong panlaba? Salamat sa iyong sagot. — Reno, Jr.

Dear Reno, Jr.,

Maaaring matagpuan ang kasagutan sa iyong katanungan sa Seksyon 4 ng Republic Act (R.A.) No. 8970, o “An Act Prohibiting the Manufacture, Importation, Distribution and Sale of Laundry and Industrial Detergents Containing Hard Surfactants and Providing Penalties for Violation Thereof”, kung saan nakasaad na:

“Section 4. Prohibition. - The manufacture, importation, distribution and/or sale of laundry and industrial detergents containing hard surfactants are hereby declared prohibited.  The Bureau of Product Standards shall review and revise the mandatory Philippine National Standard for ‘Surface Active Agnets-Synthetic Detergents for Laundry Use’ in accordance with this Act and monitor compliance therewith.

For this purpose, the Bureau of Product Standards shall inspect laundry and industrial detergents, whether imported or locally-manufactured, to ensure that they are free from hard surfactants.”

Batay sa nasabing batas, naging polisiya ng ating gobyerno na protektahan, siguraduhin, at pangalagaan ang mamamayang Pilipino mula sa panganib at mapaminsalang epekto ng polusyon gaya ng nakikita mula sa mga produktong inangkat mula sa ibang bansa, tulad ng sabong panlaba, dahil napag-alaman na ang mga ito ay maaaring naglalaman ng mga matapang na sangkap na mapanganib sa kalikasan.

Dahil dito, ipinagbawal ng batas ang paggawa, pag-angkat, pamamahagi, at/o pagbenta ng mga panlaba at pang-industriyang detergent na naglalaman ng mga matapang na surfactant. Ayon Seksyon 2(a) ng parehong batas, ang “hard surfactants” ay tumutukoy sa “surfactants with low biodegradability rate including chemicals such as hard or branded alkyl benzene, hard or branched alkyl benzene surfactants, hard or branded dodecyl benzene sulfonates, branched dodecyl benzene, their sodium or potassium salts and other technical names referring to the same chemical compound.”

Kaugnay nito, may mga karampatang parusa na nakasaad sa Seksyon 5 ng R.A. No. 8970 tulad ng pagpapataw ng multa:

“Section 5. Administrative Sanctions. - Any violation of this Act shall constitute a violation of a trade and industry law subject to the provisions of Executive Order No. 913 dated 7 October1983, as amended. The Bureau of Product Standards shall have the authority recommend, pursuant to Executive Order No. 913, as amended, the imposition of the administrative sanctions enumerated therein against the manufacturer, importer, distributor, and seller of laundry and industrial detergents containing hard surfactants.

In addition to the administrative sanctions imposable under Executive Order No. 913, as amended, the Bureau of Product Standards is hereby authorized to recommend the imposition of the fines in case of violation of this Act as set forth in the following schedule:

(i) First Offense, a fine of Two hundred thousand pesos (Php200,000.00);

(ii) Second Offense committed within one (1) year from the first offense, a fine of Three hundred thousand pesos (Php300,000.00); and

(iii) Third offense committed within one (1) year from the second offense, a fine of Five hundred thousand pesos (Php500,000.00).

The imposition of the foregoing administrative sanctions shall be without prejudice to the cancellation of the manufacturer’s license to operate and/or the Product Standards Quality Mark pursuant to Republic Act No. 4109, as amended.”

Kung kaya, bilang kasagutan sa iyong katanungan at base sa mga probisyon ng nasabing batas, ipinagbabawal ang paggawa, pag-angkat, pamamahagi at/o pagbenta ng mga panlaba at pang-industriyang detergent na naglalaman ng mga matapang na surfactant. Ito ay upang masigurado na ang mga produkto na ating ginagamit ay ligtas at walang anumang kemikal na matataguriang mapaminsala ‘di lamang sa kalusugan ng tao, kung hindi pati sa kalikasan.
