Pagkatapos ma-detain sa National Bureau of Investigation (NBI) ang It's Showtime host na si Vhong Navarro simula pa noong September dahil sa non-bailable na kasong rape na isinampa ni Deniece Cornejo, halos tatlong buwan na rin ang nakararaan, ililipat na ang comedian-host sa regular na kulungan sa Taguig City Jail sa Camp Bagong Diwa, Taguig City.
Siniguro naman ni BJMP-National Capital Region (NCR) Director, Chief Supt. Efren Nemeno sa pamilya ni Vhong ang safety ng aktor-TV host sa ilalim ng kanilang custody.
Ang paglilipat kay Vhong sa normal na kulungan ay isa sa mga kinatatakutan ng misis niyang si Tanya dahil hindi naman bago ang kuwento na pinaparusahan ng mga inmates ang mga bagong dating na preso sa kanilang selda.
Samantala, ang latest update, idinenay ng Court of Appeals (CA) ang petisyon ni Vhong na ma-reverse ang acquittal ni Jed Fernandez, isa sa mga kinasuhan niya ng grave coercion kaugnay ng rape case sa kanya.
The CA ruled that Vhong has no legal standing to file the petition for certiorari because the actor-comedian didn’t get the consent and authority of the Office of the Solicitor General, which represents the state, as the complainant in a criminal case.
Ang nasabing petition ay nai-file ni Vhong matapos ngang i-acquit ng Taguig City Regional Trial Court (RTC) si Fernandez sa pakikipagsabwatan kina Deniece Cornejo at Cedric Lee sa pamimilit kay Vhong na pirmahan ang police blotter.
Judge Marivic Vitor of the CA affirmed the ruling of the RTC and added that the presence of Jed during the time of Vhong signing the police blotter was insufficient to prove conspiracy.
Samantala, ang mga apela nina Deniece at Cedric ay na-dismissed due to the lack of merit — kaya convicted pa rin sila sa grave coercion.
The CA was not convinced with the actor’s claim of mistrial resulting in a denial of due process.
They ruled that Vhong was “afforded the opportunity to be heard by the RTC.”
"On the contrary, the records reveal that Navarro and all the accused were not denied the opportunity to be heard as they were required to file their appeal memorandum. More significantly, Fernandez's Memorandum dated May 2, 2019 as well as Cornejo's and Lee's joint Memorandum of Appeal dated May 7, 2019 were duly filed with and admitted by the RTC,” the resolution wrote.
