Dear Chief Acosta,
Napagbintangan ang asawa ko dahil sa isang krimen na hindi naman niya talaga ginawa. May walong buwan na rin siyang nagtitiis sa piitan, habang ang mga anak namin ay nagtitiis din na walang ina na gumagabay sa kanila. Ako man ay nahihirapan na rin lalo na at wala na akong ililiban sa trabaho bunsod ng madalas kong pagka-late at absent para tugunan ang iba’t ibang pangangailangan ng tatlo naming menor-de-edad na anak. Maaari ba akong mag-apply bilang “solo parent”? Sabi kasi ng isang kapitbahay ko, mayroon diumanong benepisyo ang mga “solo parents” na karagdagang leave credits. Dear Moises,
Sa ilalim ng Republic Act (R.A.) No. 11861, o ang Expanded Solo Parents’ Welfare Act, ang isang magulang na naiwang nangangalaga at sumusuporta sa kanyang anak dahil nakakulong ang kanyang asawa nang hindi bababa sa tatlong buwan ay kinokonsidera bilang “solo parent”. Partikular na nakasaad sa Section 4 ng R.A. No. 11861 ang sumusunod:
“Section 4. Categories of Solo Parent. – A solo parent refers to any individual who falls under any of the following categories:
(a) A parent who provides sole parental care and support of the child or children due to – x x x
(3) Detention of the spouse for at least three (3) months or service of sentence for a criminal conviction; x x x”
Upang makapagparehistro bilang “solo parent,” gayon na rin para mabigyan ng kaukulang card at booklet, kinakailangan na maisumite sa Solo Parents Office o Solo Parents Division ng probinsya, siyudad o munisipalidad kung saan ka residente ang authenticated o certified true copies ng mga sumusunod na dokumento:

c. For the solo parent on account of the detention or criminal conviction of the spouse falling under Section 4(a)(3) of this Act:
(1) Birth certificate/s of the child or children.
(2) Marriage certificate.
(3) Certificate of detention or a certification that the spouse is serving sentence for at least three (3) months issued by the law-enforcement agency having actual custody of the detained spouse or commitment order by the court pursuant to a conviction of the spouse.
(4) Sworn affidavit declaring that the solo parent is not collaborating with a partner or co-partner, and has sole parental care and support of the child and children: Provided, That for purposes of issuance of subsequent SPIC and booklet, requirement numbers (3) and (4) under this paragraph shall be submitted every year; and
(5) Affidavit of a barangay official attesting that the solo parent is a resident of the barangay and that the child or children is/are under the parental care and support of the solo parent. x x x”
(Section 13, Revised Implementing Rules and Regulations (RIRR) of Republic Act No. 8972 (R.A. No. 8972) or the “Solo Parents Welfare Act of 2000”, as amended by Republic Act No. 11861 (R.A. No. 11861) or the “Expanded Solo Parents Welfare Act”)
Nais lamang naming bigyang-diin na maaari mo lamang i-avail ang pitong araw na parental leave kung ikaw ay may anim na buwan na sa iyong pinagtatrabahuhan. Para sa karagdagang kaalaman, nakasaad sa Section 7 ng R.A. No. 11861:
“Section 7. Section 7 of Republic Act No. 8972 is hereby amended to read as follows:
Section 8. Parental Leave. - In addition to leave privileges under existing laws, a forfeitable and noncumulative parental leave of not more than seven (7) working days with pay every year shall be granted to any solo parent employee, regardless of employment status, who has rendered service of at least six (6) months: Provided, That the parental leave benefit may be availed of by the solo parent employees in the government and the private sector.”
Sana ay nabigyan namin ng linaw ang iyong katanungan. Ang payong aming ibinigay ay base lamang sa mga impormasyon na iyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
