Nagnanais akong maging isang Overseas Filipino Worker (OFW). Sa kasamaang palad, matapos kong maiproseso ang lahat ng mga kinakailangang dokumento para sa aking pag-alis, bigla akong sinabihan ng aking recruitment agency na hindi na ako matutuloy. Hindi man lang ako nasabihan kung anong rason nito. Matapos pagnilay-nilayan ang mga pangyayari, napagtanto kong mas mabuti nang dito na lamang ako sa Pilipinas para alagaan ang aking mga magulang na may edad na rin. Tanong ko lamang, may pag-asa bang makuha ko ang aking mga binayad sa pagproseso ng aking mga dokumento? Nais ko sanang maliwanagan. Maraming salamat. Fatrice


 

Dear Fatrice,


Ang Department of Migrant Workers (dating Philippine Overseas Employment Agency o POEA) ang inatasan ng ating gobyerno upang pangalagaan ang kapakanan ng ating mga OFWs. Kaya naman, nagpatupad ang nasabing ahensya ng mga panuntunan at patakaran sa pamamahala ng mga land-based na OFWs. 


Binibigyang kahulugan ng Revised POEA Rules and Regulations Governing the Recruitment and Employment of Landbased Overseas Filipino of 2016 ang “illegal recruitment” at mga iba pang ilegal na gawain. Base sa Rule X, Section 76 (n) ng nasabing regulasyon:


Illegal Recruitment 


SECTION 76. Acts Constituting Illegal Recruitment. — Illegal Recruitment shall mean any act of canvassing, enlisting, contracting, transporting, utilizing, hiring or procuring workers and includes referrals, contract services, promising or advertising for employment abroad, whether for profit or not, when undertaken by a non-licensee or non-holder of authority contemplated under Article 13(f) of Presidential Decree No. 442, as amended, otherwise known as the Labor Code of the Philippines: Provided, that any such non-licensee or non-holder who, in any manner, offers or promises for a fee employment abroad to two or more persons shall be deemed so engaged. 


It shall likewise include the following prohibited acts committed by any person whether or not a licensee or a holder of authority: x x x 


n. To fail to reimburse expenses incurred by the worker in connection with his/her documentation and processing for purposes of deployment, in cases where the deployment does not actually take place without the worker’s fault;


Nasasaad sa nasabing regulasyon na ilegal ang hindi pagbalik ng mga nagastos ng manggagawa kaugnay ng kanyang dokumentasyon at pagproseso para sa mga kinakailangan sa kanyang pag-alis, kung ang kanyang pag-alis ay hindi natuloy nang walang siyang kasalanan. 


Ganito rin ang nakasaad sa Section 6(m) ng Republic Act (R.A.) No. 8042 o ang “Migrant Workers and Overseas Filipinos Act of 1995”, na inamyendahan ng Republic Act (R.A.) No. 10002.:


“SEC. 6. Definition. - For purposes of this Act, illegal recruitment shall mean any act of canvassing, enlisting, contracting, transporting, utilizing, hiring, or procuring workers and includes referring, contract services, promising or advertising for employment abroad, whether for profit or not, when undertaken by non-licensee or non-holder of authority contemplated under Article 13(f) of Presidential Decree No. 442, as amended, otherwise known as the Labor Code of the Philippines: Provided, That any such non-licensee or non-holder who, in any manner, offers or promises for a fee employment abroad to two or more persons shall be deemed so engaged. It shall likewise include the following acts, whether committed by any person, whether a non-licensee, non-holder, licensee or holder of authority; xxx


(m) Failure to reimburse expenses incurred by the worker in connection with his documentation and processing for purposes of deployment, in cases where the deployment does not actually take place without the worker’s fault. Illegal recruitment when committed by a syndicate or in large scale shall be considered an offense involving economic sabotage; and” 


Upang sagutin ang iyong katanungan, malinaw sa nasabing mga tuntunin at batas na dapat isauli ng iyong recruitment agency ang lahat ng iyong nagastos sa pagproseso ng iyong mga kinakailangan sa pag-alis. Iyan ay totoo lamang kung mapatunayan na hindi dahil sa iyong sariling kagagawan ang rason kung bakit hindi natuloy ang iyong pag-alis ng bansa. 


Sana ay nabigyan namin ng linaw ang iyong katanungan. Ang payong aming ibinigay ay base lamang sa mga impormasyon na iyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
