Dear Chief Acosta,


May katanungan ako tungkol sa disability benefits ko bilang isang seafarer. Nagtrabaho ako ng humigit-kumulang 10 taon sa ibang bansa. Ang pinasukan ko ay isang marine terminal platform na isang fixed offshore structure at ito ay nakaangkla sa ilalim ng seabed. Ngunit ang claim ko para sa aking disability benefits na nakapaloob sa Philippine Overseas Employment Administration (POEA) Standard Employment Contract (POEA-SEC) ay tinanggihan ng kumpanyang pinasukan ko dahil hindi diumano ako maituturing na seafarer. Tama bang sabihin na hindi ako maituturing na seafarer? Dear Jefferson,


Nakasaad sa Artikulo 13 (g) ng ating Labor Code of the Philippines ang kahulugan ng terminong “seaman”:


(g)‘Seaman’ means any person employed in a vessel engaged in maritime navigation.”


Ipinahihiwatig ng depinisyong ito na ang kakayahan ng isang sasakyang pandagat na makilahok sa maritime navigation ay napakahalaga sa pagtukoy kung ang isang manggagawa ay maituturing na isang seaman (ang terminong ginamit bago ang seafarer) sa ilalim ng ating Labor Code. 


Ayon naman sa Part I, Rule II (38) ng 2003 POEA Rules and Regulations Governing the Recruitment and Employment of Seafarers (2003 POEA Seafarer Rules), ang kahulugan ng “seafarer” ay:


Rule II (38). Seafarer - refers to any person who is employed or engaged in any capacity on board a seagoing ship navigating the foreign seas other than a government ship used for military or non-commercial purposes. The definition shall include fishermen, cruise ship personnel and those serving on foreign maritime mobile offshore and drilling units. x x x” 


Samantala, sa 2016 Revised POEA Rules and Regulations Governing the Recruitment and Employment of Seafarers (2016 POEA Seafarer Rules), ang kahulugan ng seafarer ay naiba na rin kumpara sa 2003 POEA Seafarer Rules. Nakalahad sa Rule II (42) at (44) nito na:


(42). Seafarer - refers to any person who is employed or engaged or works in any capacity on board a ship. xxx


 (44). Ship - means a ship other than one which navigates exclusively in inland waters or waters within or closely adjacent to, sheltered waters or areas where port regulations apply.


Sa ngayon, ang kahulugan ng seafarer sa ilalim ng Republic Act (R.A.) No. 12021, na isinabatas noong 23 Setyembre 2024, ay matatagpuan sa Seksyon 6 (aa):


“(aa) Seafarer refers to a Filipino who is engaged, employed, or is working in any capacity on board a ship covered under this Act.”


Para sa iyong kaalaman, mayroong kasong napagdesisyunan ang ating Korte Suprema na nakasasaklaw sa iyong katanungan. Ayon sa V People Manpower Philippines, Inc. vs. Buquid (G.R. No. 222311, Pebrero 10, 2021), isinulat ni Kagalang-galang na Kasamang Mahistrado Ramon Paul L. Hernando:


It must be emphasized that notwithstanding the evolution of how the POEA defines a “seafarer,” the same should still be read with Article 13(g) of the Labor Code, which contains the legal definition that may not be expanded or limited by mere administrative rules or regulations. Indeed, all the definitions mentioned would all point to the fact that in order to be considered a seaman or seafarer, one would have to be, at the very least, employed in a vessel engaged in maritime navigation. Thus, it is clear that those employed in non-mobile vessels or fixed structures, even if the said vessels/structures are located offshore or in the middle of the sea, cannot be considered as seafarers under the law.”


Kaya naman tungkol sa iyong sitwasyon, kung ikaw ay nagtrabaho sa isang marine terminal platform na isang fixed offshore structure at nakaangkla sa ilalim ng seabed, malinaw sa kasong nabanggit sa itaas na hindi ito kasama sa mga sasakyang pandagat para maituring na seafarer ang nagtatrabaho rito. 


Ang kahulugan din ng seafarer ay hindi lamang nakadepende sa trabaho o posisyon ng manggagawa, ngunit ito rin ay nakabatay sa uri ng marine vessel o offshore unit kung saan nakatalaga ang manggagawa habang siya ay empleyado. Kaya naman sa iyong naging trabaho, maaaring maituring ka na isang land-based worker at hindi seafarer. 


Sana ay nabigyan namin ng linaw ang iyong katanungan. Ang payong aming ibinigay ay base lamang sa mga impormasyon na iyong inilahad at maaaring magbago kung mababawasan o madaragdagan ang mga detalye ng iyong salaysay.
