Dear Popoy,
Para sa iyong kaalaman, ang panuntunan na nakasasaklaw sa iyong katanungan ay ang Revised Rules on Criminal Procedure. Nakasaad sa Rule 126, Section 10 nito na:
“Section 10. Validity of search warrant. — A search warrant shall be valid for ten (10) days from its date. Thereafter it shall be void.”
Kaugnay nito, nakasaad din sa Rule 113, Section 4 ng nasabing panuntunan na:
“Section 4. Execution of warrant. — The head of the office to whom the warrant of arrest was delivered for execution shall cause the warrant to be executed within ten (10) days from its receipt. Within ten (10) days after the expiration of the period, the officer to whom it was assigned for execution shall make a report to the judge who issued the warrant. In case of his failure to execute the warrant, he shall state the reasons therefor.”
Bukod pa rito, may inilabas na Administrative Circular No. 13 ang Korte Suprema, na may paksa hinggil sa Guidelines and Procedure in the Issuance of Search Warrants, kung saan sinabing – “the search warrant shall be valid for ten (10) days from date of issuance, and after which the issuing judge should ascertain if the return has been made, and if there was none, should summon the person to whom the warrant was issued and require him to explain why no return was made. xxx”
Sang-ayon sa mga nabanggit, ang isang search warrant ay may bisa lamang na 10 araw.
Pagkatapos nito, nawawalan na ng bisa ang nasabing search warrant at dapat nang mag-report sa hukom na nag-issue nito kung ano ang nangyari.
