MALINAW na nakasaad sa Articles 152, 153 at 154 ng Executive Order No. 209 o ang Family Code of the Philippines ang mga sumusunod na probisyon:
“Art. 152. The family home, constituted jointly by the husband and the wife or by an unmarried head of a family, is the dwelling house where they and their family reside, and the land on which it is situated.
Art. 153. The family home is deemed constituted on a house and lot from the time it is occupied as a family residence. From the time of its constitution and so long as any of its beneficiaries actually resides therein, the family home continues to be such and is exempt from execution, forced sale or attachment except as hereinafter provided and to the extent of the value allowed by law.
Art. 154. The beneficiaries of a family home are:
(1) The husband and wife, or an unmarried person who is the head of a family; and
(2) Their parents, ascendants, descendants, brothers and sisters, whether the relationship be legitimate or illegitimate, who are living in the family home and who depend upon the head of the family for legal support.”
Sang-ayon sa batas, ang pamilya ay mayroong karapatang magtatag ng kanilang tahanan o ang tinatawag na family home kung saan sila ay titira bilang pamilya. Ang beneficiaries ng family home ay ang asawang babae at lalaki o isang walang asawa subalit, siya ang nagsisilbing ulo ng pamilya o head of the family kasama ang kanilang mga magulang, anak, kapatid, lehitimo man o hindi na naninirahan sa nasabing tahanan at nakadepende sa suporta mula sa tinaguriang head of the family.
Ang family home ay ang bahay at lupa na ginawang tirahan ng pamilya. Mananatili itong family home hanggang sa sinuman sa beneficiaries nito ay nakatira rito. Ang family home ay hindi maaaring maging kabahagi ng execution o pagpapatupad ng decision ng husgado sa kaso na isinampa laban sa beneficiaries ng family home.
